We accept various currencies (USD, AUD, EUR, NZD, GBP, FJD) and credit cards (with a 3% fee, excluding Amex). Please note that we do not store full credit card details on our servers; this information is securely processed by our payment partners .

· Booking and Travel Information: Details regarding your dive certifications (e.g., PADI Open Water certification), dietary requirements, medical information relevant to diving, flight details, and other preferences necessary to arrange your travel itinerary .

· Technical Data: When you visit our Site, we may automatically collect information sent by your browser, such as your IP address, browser type, the pages of our Site that you visit, the time and date of your visit, and the time spent on those pages. This is used for analytics to improve our website.

 

2. How We Use Your Information

· To Process and Manage Bookings: To arrange your dive travel, including resort accommodations, boat dives, internal transfers, and activities like shark diving in Beqa Lagoon or whale swims in Tonga .

· To Communicate With You: To send you booking confirmations, respond to your inquiries (including those submitted via our "Waterlust Dive Package Request" forms), provide travel updates, and inform you of any changes to your itinerary .

· To Personalize Your Experience: To understand your preferences (e.g., preferred dive sites like Rainbow Reef or Bligh Water) and tailor our recommendations accordingly.

· To Process Payments: To facilitate transactions in your chosen currency and issue invoices .

· To Improve Our Services: We analyze usage data to enhance our website, optimize our offerings, and ensure we provide the best possible local knowledge and travel hacks .

Terms and Conditions

1. Introduction and Acceptance of Terms

Welcome to Waterlust Fiji,  the trading name of UK registered Turquoise Waka Ltd. By accessing our website, making a booking, or participating in any of our tours, dive trips, or activities (collectively, the "Services"), you agree to be bound by these Terms and Conditions. If you are making a booking on behalf of others, you guarantee that you have the authority to bind those individuals to these terms.

2. Bookings, Payments, and Cancellations

2.1 Reservation and Payment

· Deposit: A non-refundable deposit of between 20 - 30% per person is required to confirm your booking . Waterlust Fiji abides by the conditions that it will pay this deposit to secure the rooms with the relevant Fiji dive resorts. 


· Final Payment: The balance of the booking cost is due no later than 30 days and in some cases 60 days prior to your scheduled arrival date . If full payment is not received by the due date, we reserve the right to treat the booking as cancelled and retain the deposit - paid to your chosen dive resort. 
· Payment Methods: We accept Visa, Mastercard, bank transfer. A surcharge of 3% may apply to credit card payments .

2.2 Cancellation by Client - Refund Policy

All cancellations must be received in writing. Cancellation charges are based on the date we receive your notice and are calculated as a percentage of the total booking price:

· More than 60 days before arrival: Loss of deposit only .
· Less than 60 days 100% of total booking cost .
· No-shows and Early Departure: No-shows will be charged the full cost of the booking. No refunds will be made for unused portions of a package or for unused hotel nights if you depart early .

2.3 Group Bookings

Bookings for 5 or more divers are considered "Group Bookings" and may be subject to separate payment and cancellation terms, including different deposit amounts and penalty deadlines. Group members must travel and dive together as booked; failure to do so may result in loss of preferential group pricing and additional transfer fees .

3. Diving Activities, Safety, and Assumption of Risk

3.1 Medical and Physical Fitness

You certify that you are in good physical and mental health and medically fit to scuba dive . You acknowledge that diving is a strenuous activity. You agree to complete any medical statement required by our dive professionals honestly. If you are taking medication, you affirm that you have consulted a physician and have approval to dive .

3.2 Certification and Experience

You must be a certified scuba diver with a recognized agency (e.g., PADI, SSI) and present your certification card on request. You are responsible for diving within the limits of your training and experience . We reserve the right to refuse service to anyone we deem unprepared or unsafe for a dive, without refund.

3.3 Assumption of Risk and Waiver of Liability

You acknowledge that scuba diving and associated water activities (including but not limited to boat travel, snorkeling, and swimming) are inherently dangerous . The risks include, but are not limited to: drowning; decompression sickness ("the bends"); air embolism; hyperbaric injury; injury from marine life; equipment failure; and perils of the sea .

By accepting these terms, you agree to the following on behalf of yourself, your heirs, and your estate:

· To assume all risks associated with the activities .
· To release and hold harmless Waterlust Fiji  its employees, owners, agents, and vessel operators (the "Released Parties") from any liability for personal injury, death, or property damage arising from your participation, even if caused by the negligence (including gross negligence) of the Released Parties .
· Not to sue the Released Parties for any claims arising from the activities .

3.4 Equipment

You are responsible for inspecting all rental equipment before diving and should not dive with equipment that is not functioning properly. All equipment is provided "as is" .

4. Operational Logistics and Force Majeure

4.1 Changes to Itinerary

We plan our itineraries carefully, but we reserve the right to alter routes, schedules, or activities without notice due to weather conditions, safety concerns, mechanical issues, or other unforeseen circumstances . We are not responsible for any costs or losses incurred as a result of such changes.

4.2 Weather and Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: acts of God, cyclones, storms, pandemics, strikes, war, terrorism, or government restrictions . No refunds will be given for trips cancelled due to weather if it is unsafe to dive.

4.3 Medical Facilities and Evacuation

You acknowledge that dive sites and resorts in Fiji are often remote from recompression chambers and advanced medical facilities . In the event of an emergency, evacuation may be delayed. You are solely responsible for the costs of any such evacuation or emergency medical treatment . 
5. Client Responsibilities and Conduct

5.1 Travel Documents and Insurance

· Passports and Visas: You are solely responsible for ensuring you have a valid passport (with at least six months validity from your return date) and any required visas for entry into Fiji .


· Travel Insurance: It is recommended  that you have comprehensive travel insurance that specifically covers scuba diving, including medical expenses, emergency evacuation (e.g., helicopter/air ambulance), and cancellation costs . Y

5.2 Behaviour and Compliance

You agree to comply with all instructions from our resort partners' crew, dive guides, and the vessel captains. Our partner resorts reserve the right to refuse or terminate the participation of any person whose behaviour is disruptive, dangerous, or under the influence of drugs or alcohol . No refunds will be provided in such cases.

5.3 Minors

For any participant under the age of 18, a parent or legal guardian must sign the relevant waivers and is responsible for their supervision at all times .

6. Limitation of Liability

To the maximum extent permitted by Fijian law, in no event shall Waterlust Fiji  be liable for any indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with the use of our services, our website, or the delay or inability to use our services.

7. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Fiji. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Fiji .
